L’article s’intéresse à l’autorité des décisions judiciaires à la lumière des observations faites en 2022 par les juges de la Cour suprême du Canada sur la théorie du stare decisis et, en tenant compte de ces commentaires, discute des répercussions de la décision Société canadienne des auteurs, compositeurs et éditeurs de musique c. Entertainment Software Association, 2022 CSC 30 sur le droit d’auteur canadien.

ABSTRACT
The article examines the authority of judicial decisions in light of the opinions issued in 2022 by the justices of the Supreme Court of Canada on the theory of stare decisis and, with those comments in mind, discusses the impact of the decision Society of Composers, Authors and Music Publishers of Canada v. Entertainment Software Association, 2022 SCC 30 on Canadian copyright law.
